These Terms and Conditions ("Terms") govern your access to and use of the website located at takeflightstudios.ca (the "Site"), any demo website generated for you or a business you represent, and any web design, hosting, or related services (collectively, the "Services") provided by Take Flight Studios, a business based in West Perth, Ontario, Canada ("Take Flight Studios," "we," "us," or "our"). By accessing the Site, viewing a demo website we created, or purchasing a plan, you ("you," "Client," or "Customer") agree to be bound by these Terms. If you do not agree, do not use the Site or the Services.
Take Flight Studios provides done-for-you website design and hosting services for trades and service businesses, including: Free Demo Websites — a complimentary, single-page website concept built on a Take Flight Studios-owned subdomain and shared with prospective clients for preview purposes only. The Launch Package — a paid monthly subscription that includes a custom single-page website, monthly maintenance and content updates, performance and security monitoring, and basic analytics, subject to a minimum 3-month term. The Growth Package — a paid, month-to-month subscription that includes everything in the Launch Package plus domain support from day one, priority support and onboarding, ongoing conversion rate optimization (CRO) and search engine optimization (SEO) adjustments, and periodic growth reviews. We may modify, rename, or discontinue any plan, or introduce new plans, at our discretion, with notice to active subscribers before changes take effect on their account.
3.1 Free demo websites are provided for evaluation purposes only, remain live for a limited period (currently 14-30 days from creation, unless otherwise stated), and do not include domain connection, ongoing support, or any guarantee of continued availability. 3.2 Demo websites are created using publicly available factual information about a business (such as its name, address, phone number, listed services, and factual claims like review counts), combined with original design, layout, and copy created by Take Flight Studios or generated with the assistance of AI tools. We do not reproduce a business's existing creative content, images, or logos without permission. 3.3 Each demo website includes a visible disclaimer identifying it as an unofficial concept created by Take Flight Studios for demonstration purposes, stating that it is not affiliated with, sponsored by, or endorsed by the business it references, and providing a direct means of contacting us to request removal. 3.4 If you are the subject of a demo website and did not request it, you may request its immediate takedown at any time by emailing info@takeflightstudios.ca. We will honor takedown requests promptly. 3.5 Demo websites may be generated with the help of third-party AI website-building tools. We review demo output before it is shared, but as with any AI-assisted content, we make no guarantee that it is error-free, and we do not warrant its accuracy, completeness, or fitness for any particular purpose until it has been reviewed and approved as part of a paid plan.
4.1 Plans are billed monthly in advance using the payment method on file. There are no upfront design fees; the subscription fee covers design, build, and ongoing service as described in the applicable plan. 4.2 The Launch Package requires a minimum term of 3 consecutive monthly payments. You may cancel the Launch Package after the initial 3-month term is complete. The Growth Package has no minimum term and may be canceled at any time, effective at the end of the current billing cycle. 4.3 Failure to pay a subscription fee when due may result in suspension of the website and associated services until payment is received. 4.4 We may change plan pricing with at least 30 days' notice to active subscribers. Continued use of the Services after a price change takes effect constitutes acceptance of the new pricing.
5.1 Full domain transfer or handoff of your website to your own domain or another provider is included at no additional cost once you have completed 3 consecutive paid months on the Launch Package or Growth Package. 5.2 If you request a full domain transfer or handoff before completing 3 consecutive paid months, a one-time Domain Setup & Handoff fee applies. This fee will be disclosed to you in writing before it is charged and will exceed the total value of 3 months of your plan. 5.3 We are not responsible for delays, downtime, or configuration issues caused by third-party domain registrars, DNS providers, or hosting services outside our direct control, though we will provide reasonable assistance to resolve such issues.
6.1 Upon full payment for a website build, Take Flight Studios grants you a non-exclusive license to use the final design and content for your business. Underlying templates, frameworks, code libraries, and design systems developed by Take Flight Studios remain our property and may be reused across other client projects. 6.2 You represent that any content, images, logos, or copy you provide to us for use in your website are either owned by you, properly licensed to you, or otherwise lawful for you to use, and you agree to indemnify us against claims arising from content you supply. 6.3 We will not knowingly reproduce another business's copyrighted creative content, brand assets, or trademarked logos in any demo or paid website without authorization. Where a demo references a third-party business by name for identification purposes, this is a factual, nominative reference only and does not imply affiliation or endorsement.
7.1 If you receive outreach from us by email, it will include accurate sender identification, a valid contact address, and a working opt-out or unsubscribe mechanism, in accordance with Canada's Anti-Spam Legislation (CASL) and, where applicable, the U.S. CAN-SPAM Act. 7.2 You may opt out of marketing communications from us at any time using the unsubscribe link provided or by emailing info@takeflightstudios.ca. Opt-out requests will be honored promptly.
8.1 THE SERVICES AND ANY DEMO OR PAID WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAKE FLIGHT STUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 8.2 We are not liable for indirect, incidental, special, or consequential damages, including loss of business, revenue, or data, arising from your use of the Services or any website we build, host, or maintain, except where such liability cannot be excluded by law. 8.3 Our total liability to you for any claim arising from the Services is limited to the total amount you paid to us in the 3 months preceding the event giving rise to the claim. 8.4 Some website functionality may rely on third-party platforms (such as payment processors or hosting providers). We are not responsible for outages, errors, or policy changes originating from those third parties.
9.1 We may suspend or terminate your access to the Services if you fail to pay fees when due, violate these Terms, or use the Services for unlawful purposes. 9.2 Upon termination for any reason, outstanding fees remain due, and domain transfer rights described in Section 5 continue to apply based on payments already completed.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
We may update these Terms from time to time. Material changes will be posted on the Site with an updated effective date. Continued use of the Site or Services after changes take effect constitutes acceptance of the revised Terms.
